| All material remains the property of Horticultural Photography(TM) and Horticultural Photography(TM) retains copyright to all works. If images are used on an Internet web site, Horticultural Photography shall be notified of such use and copyright attributed to Horticultural Photography. User shall maintain a cross reference between the Horticultural Photography reference number and its in-house reference number. |
| All material is offered by Horticultural Photography(TM) with certain exceptions for limited one time copyright use. |
| Licensing of the original 4 color transparency is limited to the sole use of the original purchaser and may not be resold, rented, loaned, sold, or gifted for any reason whatsoever, without written permission of Horticultural Photography for any purpose. This includes separations and digital images made from the original transparencies. |
| Transparencies may be duplicated, scanned and/or digitized as required for the specific use negotiated. Written permission from Horticultural Photgraphy is needed prior to making any alterations, additions, or subtractions in respect of the licensed photographs, alone or with any other material, by use of computer or other electronic means or any other method or means now or hereafter known. |
| Originals are to be returned to Horticultural Photography(TM) after duplicates or scans are made. |
| All material while in possession of the client and returns in transit must
be fully insured against fire, theft, loss and/or damage. |
| Returns of "can't use" materials are to be sent back within 30 days of receipt. Please let us know if submissions are to be held longer because of your publishing schedule. |
| Payment is to be made to Horticultural Photography(TM). Tax ID will be provided upon request. |
| In the event that use is made (published or otherwise) of Horticultural Photography's property prior to payment as per these "Terms of Submission, Sale and Rates". Horticultural Photography(TM) reserves the right to charge $1,000.00 per unit and expenses incurred for the recovery of his property and legal fees and appeals. Re: violation of his common law copyrights of same, loss or destruction. |

Nursery trade "catalog use" |
Printed catalogs:
Image is used for plant identification (1/4 page or less) - $150. Purchasing nursery trade catalog use rights entitles you to make a four color separation or digitize the transparency and use it in your catalog for five years. If after five years you want to continue using the photo in your catalog, the cost per year will be 20% of our then current price for "catalog use". Special rates are available for members of the ANLA. |
Web catalogs
Iinternet only use where digital image is provided at 100 dpi or less for illustration of plant material to be sold, $12.00 per year (image size 106 x 150 pixels), $18.00 per year (image size 247 x 350 pixels). $25.00 per year for both sizes. For 25 or more images, call for pricing. |

| Buyouts/exclusive rights to use in a specific field at 3.5 times original fee or by agreement. |
| A library fee of $50.00 per hour will be charged if slides and slide sheets are not returned in the same order as originally submitted. |
